Terms of Service

You must be at least 13 years old to create an account. If you're under 18, you confirm a parent or legal guardian has reviewed and consented to these terms on your behalf. By booking a paid session you confirm you have the legal authority to enter into a binding contract.

• You are responsible for maintaining the security of your password and all activity that occurs under your account.
• Notify us immediately at security@bluecouchperformances.com of any unauthorized access.
• You may not transfer your account to anyone else.
• One person, one account. We may suspend duplicate accounts.

• When you book a session, slot, or event, you authorize us (via Stripe) to charge the displayed amount to your selected payment method.
• Booking is confirmed only after payment succeeds and our team approves the request. Until then, your slot is held for up to 30 minutes after checkout begins.
• Cancellations by you: requests made more than 48 hours before your session are eligible for a full refund. Cancellations under 48 hours may be refunded at our discretion or rescheduled.
• Cancellations by us: if we cancel a session or event, you receive a full refund automatically.
• Rejected bookings: if we reject your booking after payment, we issue a full refund to your original payment method within 5–10 business days.
• All amounts are in US dollars unless otherwise noted.

You retain ownership of every video, image, and message you upload. By uploading, you grant Blue Couch Performances a worldwide, royalty-free, non-exclusive license to host, store, transcode, display, and promote your content within and about the platform (including in trailers, social media, and event recap videos).

You also grant other users a limited license to view, vote on, and share your content within the platform's social features.

You promise that everything you upload is yours, you have permission to use any samples / beats / third-party material, and it does not violate anyone's intellectual property, privacy, or publicity rights.

You agree not to:

• Upload content that is illegal, defamatory, harassing, hateful, sexually explicit, or threatens violence.
• Infringe anyone's copyright, trademark, or other rights — including using copyrighted beats or samples you don't have rights to.
• Impersonate other people or organizations.
• Scrape, reverse-engineer, or interfere with the platform.
• Use the platform to spam, phish, or distribute malware.
• Resell or commercially exploit the platform or its content without our written permission.

We may remove content or suspend accounts that violate these rules. Repeat infringers will have their accounts permanently terminated under our DMCA policy.

The Blue Couch Performances name, logo, "BCP" mark, design, and all underlying software and design assets are owned by us and protected by intellectual-property laws. You may not copy or use them without our written permission, except for ordinary use of the platform.

The platform integrates with third-party services (Stripe, Cloudinary, Resend, Twilio, Apple Push Notification service, Firebase Cloud Messaging, Google Sign-In, etc.). Your use of those services is subject to their own terms — we're not responsible for what they do.

You may delete your account at any time from your settings. We may suspend or terminate your account immediately if you breach these terms or if required by law. After termination, you lose access to your content; we may retain some data as described in our Privacy Policy.

The platform is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, or that any specific feature will remain available. To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, Blue Couch Performances and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

Some jurisdictions don't allow limits on liability for personal injury, fraud, or other matters; nothing in these terms limits liability that can't be limited under applicable law.

You agree to indemnify and hold Blue Couch Performances harmless from any claims arising out of (a) content you upload, (b) your breach of these terms, or (c) your violation of any third-party right, including intellectual-property rights.

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New York, NY, and you consent to that jurisdiction. Both parties waive any right to a jury trial.

We may update these terms. If changes are material we'll notify you by email or in the app at least 14 days before they take effect. Continued use after the effective date means you accept the updated terms.
